SwiftSites Referral Portal Affiliate Program Terms of Service

Introduction By signing up to be an Affiliate in the SwiftSites Referral Program (“Program”), you agree to be bound by the following terms and conditions (“Terms of Service”).

SwiftSites reserves the right to update and change the Terms of Service at any time, and such changes shall be effective immediately. Continued use of the Program after such changes shall constitute your consent to those changes.

Account Terms

1. You must be 18 years or older to participate in this Program.
2. You must reside in the European Union or Ireland to be an Affiliate.
3. You must be a human. Accounts created by “bots” or other automated methods are not permitted.
4. You must provide your full legal name, a valid email address, and any other necessary information during signup.
5. Your login may only be used by one individual — shared logins are prohibited.
6. You are responsible for maintaining the security of your account and password. SwiftSites is not liable for any loss or damage resulting from your failure to comply with this security obligation.
7. You are responsible for all content posted and activities that occur under your account.
8. One person or legal entity may only have one account.
9. You may not use the Program for illegal or unauthorized purposes. You must not violate any laws in your jurisdiction, including copyright laws.
10. You may not use the Program to earn commissions from your own SwiftSites products.

Links and Graphics Once you have signed up, you will be assigned a unique Affiliate Code. You are permitted to place links, banners, or other graphics with your Affiliate Code on your site, emails, or other communications. These materials must follow the guidelines and formats provided by SwiftSites.

To ensure proper tracking and referral fee accrual, use only the special links (referred to as “Special Links”) provided by SwiftSites. You will only earn referral fees on sales made through properly formatted and tracked Special Links.

Referral Fees/Commissions and Payment Referral fees will only be paid for sales that are tracked via Special Links on your site or in other communications. Commissions are paid once we receive full payment from the customer. This process may take up to 4 weeks as SwiftSites builds the website before receiving payment from the client.

Affiliate commissions are paid monthly as long as the total commissions exceed €20. If you do not meet the €20 threshold, commissions will roll over to the following month. Payments are made only after we receive payment from the customer, and we will pay you promptly once we receive it.

Identifying Yourself as an Affiliate You must not issue any press releases regarding your participation in this Program. You may not misrepresent your relationship with SwiftSites or imply endorsement, support, or sponsorship by SwiftSites unless explicitly allowed by the Agreement.

Payment Schedule Affiliates will be paid monthly, provided their earned commissions exceed €20. If commissions are below this threshold, payment will roll over to the following month. Commissions will only be paid after we have received full payment from the customer. Payment is made promptly once SwiftSites receives it.

Customer Definition Customers who make purchases through this Program will be considered SwiftSites’ customers. All customer orders, service, and product policies will apply, and SwiftSites reserves the right to modify its policies at any time.

Affiliate Responsibilities

1. You are solely responsible for the operation and maintenance of your website.
2. You must ensure that any content or materials posted on your site comply with applicable laws and regulations, including privacy policies and intellectual property laws.
3. You must ensure that your site does not infringe on the rights of any third party, including copyright or trademark laws.

Compliance with Laws You agree to comply with all applicable laws and regulations while participating in this Program, including but not limited to privacy laws and marketing laws such as GDPR (General Data Protection Regulation).

Program Duration and Termination This Agreement begins upon acceptance of your Program application and continues until terminated by either party. Either you or SwiftSites may terminate this Agreement at any time with written notice. Upon termination, you must immediately cease using and remove all links to SwiftSites, as well as any related trademarks or logos.

Termination SwiftSites reserves the right to suspend or terminate your account for any reason, including fraudulent or aggressive sales practices. Upon termination, all potential commissions will be forfeited if the violation is deemed significant.

Relationship of the Parties You and SwiftSites are independent contractors. This Agreement does not create any form of partnership, joint venture, or employee relationship.

Limitations of Liability SwiftSites will not be liable for indirect, special, or consequential damages arising from this Agreement. Our total liability under this Agreement will not exceed the referral fees paid to you.

Disclaimers SwiftSites makes no express or implied warranties regarding the Program or the products sold through it. We do not guarantee that the operation of SwiftSites will be uninterrupted or error-free.

Independent Investigation You acknowledge that you have read and understood this Agreement and that you are not relying on any representation or guarantee other than those explicitly stated here.

Arbitration Disputes under this Agreement will be resolved through arbitration under the laws of Ireland and the European Union. Any dispute involving intellectual property violations may be addressed in a court of competent jurisdiction.

Miscellaneous This Agreement is governed by the laws of Ireland and the European Union. It may not be assigned without prior written consent from SwiftSites. Any failure to enforce a provision of this Agreement does not waive the right to enforce it in the future.
